I Scope of application
1.1 «Raiko Lashes & Beauty/ Reine Raiko beauté» offers an e-commerce service specializing in eyelash extensions (sale of products for professionals and eyelash extension training) edited by Mrs. Raisa Schiopu.
1.2 These general terms and conditions of sale (hereinafter: GTC) apply to all orders placed on the following website: www.reineraiko.ch. Acceptance of these GCS is affected by making the said conditions available and the consumer’s acceptance to be subject to them at the bottom of the page.
II Service
2.1 Raiko Lashes & Beauty / Reine Raiko beauté undertakes to offer the services, products and offers for as long as they are visible on the site, within the limits of available stocks. Raiko Lashes Beauty / Reine Raiko beauté reserves the right at any time to modify the scope of the services or to suspend the execution of certain services.
2.2 Upon receipt of your order, a check of the availability of the product(s) ordered. In the event of unavailability, Raiko Lashes & Beauty / Reine Raiko beauté undertakes to check the availability of the product(s) ordered within 30 days from the validation of the order:
- To deliver the ordered product to you; or,
- To offer you a similar product at a similar price; or,
- You will receive a refund if the amount of the product is more than CHF 200 or in the form of a voucher if the amount of the product is less than CHF 200.
Within 30 days following the issue of a voucher, a request for cancellation and refund (containing the order number and full contact details) may be sent by post against acknowledgement of receipt to the following address:

2.3 In the event of a stockout on certain products in your order, the order will still be dispatched without these products.
III Conclusion of the contract of sale
3.1 The overview of offers, services and products on the website is only valid as an offer for the provision of goods and/or services by Raiko Lashes & Beauty / Reine Raiko beauté. Every order that is subsequently confirmed by “double-clicking“, constituting an electronic signature, is deemed to constitute acceptance of the offer.
3.2 The contract shall be deemed to have been concluded on the day of receipt of the order confirmation.
3.3 The sale of the products and services presented on the website is reserved for consumers domiciled in Switzerland. In the absence of a domicile, the sale is open to consumers having their usual residence in Switzerland.
IV Prices and terms of payment
4.1 The prices in the catalogue available on the site are indicated in Swiss francs, net amounts, including VAT and guaranteed. Prices do not include order processing, transport or delivery costs. Raiko Lashes & Beauty / Reine Raiko beauté reserves the right to modify prices at any time, the rate applicable to a service being that in force at the date of the order placed.
4.2 Lashes & Beauty / Reine Raiko beauté has chosen to choose two methods of payment in order to best satisfy the availability of its consumers. In the case of payment by PayPal, payment is made via a highly secure bank server. In the case of payment by bank transfer Raiko Lashes & Beauty / Reine Raiko beauté shall bear the costs associated with the transactions.
4.3 Payment of the price is due as soon as the order is placed. In the event of non-payment, Raiko Lashes & Beauty / Reine Raiko beauté reserves the right not to provide its services in accordance with Article 82 of the Swiss Code of Obligations (SR 220).
4.4 In the event of total or partial non-payment, Raiko Lashes & Beauty / Reine Raiko beauté reserves the right to refuse to honour an order from the same consumer with whom a payment dispute is in progress.
V Delivery
5.1 Orders are delivered to the delivery address indicated during the ordering process. Subject to good reason, the delivery address cannot be changed between the online order and receipt of the order.
5.2 As soon as the order has been validated, an available item is dispatched within an average of 2-3 working days. In other cases, the missing item will be ordered from the suppliers, availability may vary between 3-30 days depending on the type of products ordered.
5.3 Available items are sent by Swiss Post within 5-8 working days. These deadlines are for information purposes only and Raiko Lashes & Beauty / Reine Raiko beauté cannot be held responsible for any failure to comply with these deadlines, nor can it be held liable for interest on arrears.
5.4 Upon receipt of the delivery, the buyer is obliged to check the status of the orders received as soon as he can. Any anomaly concerning the delivery (damage, missing product in relation to the delivery note, damaged package, broken products, etc.) must imperatively be indicated on the carrier’s delivery slip in the form of “handwritten reservations” duly detailed, dated and accompanied by the buyer’s signature. In addition, the buyer must also report this anomaly by sending Raiko Lashes & Beauty / Reine Raiko beauté a letter against acknowledgement of receipt setting out the said claims within 2 working days of delivery.
5.5 If the defect in the product ordered is claimed after the deadline, the claim will be deemed to be definitively rejected, subject to the notification of a hidden defect.
VI Warrant
6.1 The product is presumed to be in conformity with the contract if it corresponds to the description given and the qualities presented by the seller on his Internet site; if it is suitable for any special use sought by the buyer, if the buyer has informed the seller at the time of the conclusion of the contract and the seller has accepted it; if it is suitable for the uses for which products of the same type are normally used; if it has the quality and performance customary for a product of the same type which the buyer may reasonably expect, having regard to the nature of the goods and, where appropriate, taking into account public statements made on the specific characteristics of the product by the seller, by the producer or by his representative, in particular in advertising or labelling.
6.2 The product can be the subject of a request for return, within 7 days following delivery for retraction, within 15 days for the return of a defective product. Any claim made outside these deadlines will not be accepted subject to just cause. The returned product will only be accepted if it has been kept in its original state, in particular with its original packaging, being suitable for re-marketing. No retraction will be accepted if the returned product is unsuitable for re-marketing. Failing this, the product will be returned to the buyer at his own expense.
6.3 In order to identify and process returns in the best possible way, any product that needs to be returned must be the subject of a return request to Raiko Lashes & Beauty / Reine Raiko beauté, failing which it will be refused. As soon as the return has been established and agreed, the buyer has 15 days to return the product to the seller. Raiko Lashes & Beauty / Reine Raiko beauté is not responsible for the return shipment. The sender of the package must take the necessary measures to ensure that the package arrives at its destination, in particular with the relevant postal services.
Upon receipt of the returned package, the seller takes the liberty of checking the conformity of the returned product. If the returned product is not in conformity, if the return has been made under the wrong motive, it will be refused and will be sent back to the buyer, at his expense. In the event of a wrong reason, the buyer will have the possibility to requalify the reason for the return and initiate a new return request.
6.4 In case of return for retraction, after receipt and acceptance of the returned order, depending on the nature of the product, the available stocks and according to the buyer’s wishes, an exchange product of equivalent value may be sent back. The return costs in the event of retraction remain the responsibility of the customer.
6.5 In the event of a lack of conformity, provided that the buyer has complied with the rules concerning the inspection of the item and the notification of defects, Raiko Lashes & Beauty / Reine Raiko beauté undertakes to ascertain the defective product, replace it or reduce the price for the loss in value, without additional costs, subject to the liability of the manufacturer(s).
6.6 In the event of the package being returned by the service provider responsible for delivery with the mention “Does not live at the address indicated”, depending on the nature of the product, available stocks and according to the buyer’s wishes, it is possible to reship the initial order, on request and at the buyer’s expense. VII Liability (rc, product defect, supplier)
7.1 In the event of a breach of its own contractual obligations under these GTC, Raiko Lashes & Beauty / Reine Raiko beauté shall be liable to the purchaser without limitation for direct and proven damage caused by Raiko Lashes & Beauty / Reine Raiko beauté through unlawful intent or gross negligence.
7.2 Any liability for collateral, indirect and consequential damages is expressly excluded.
7.3 Raiko Lashes & Beauty / Reine Raiko beauté reserves the right to exclude any liability arising from product defects, design faults, manufacturing faults or presentation faults for which it is not responsible, in particular any damage resulting from bodily injury, material damage or moral harm, in accordance with the Swiss Federal Law on Product Liability (SR 221.112.944).
VIII Intellectual property and data protection
8.1 The Internet catalogue and all content accessible in the shop is protected by copyright and is the exclusive and complete property of Raiko Lashes & Beauty / Reine Raiko beauté, unless otherwise agreed. Reproduction (in whole or in part), distribution, transmission (electronically or by other means), modification, linking or use of the contents for illegal or immoral purposes is prohibited without permission.
8.2 All personal data will be treated as confidential. The information necessary for the management of the order will be subject to computer processing and may be communicated to associated companies as part of the management of the order.

IX Final provisions (place of jurisdiction, applicable law, amendments to the GTC)
9.1 The place of performance for the characteristic services is the headquarters of Raiko Lashes & Beauty / Reine Raiko beauté in Lausanne.
9.2 Raiko Lashes & Beauty / Reine Raiko beauté reserves the right to amend these GTC at any time. The GTC in force on the day of the order will apply to the order.
9.3 Should one or more provisions of these GTC be or become null and void or unenforceable, in whole or in part, this shall not affect the validity of the remaining provisions of these GTC. In such a case, the parties will replace the null and void and unenforceable provision with a valid and enforceable provision that meets the economic purpose of the provision to be replaced to the greatest extent possible. This also applies in the event that these GTC should contain a loophole in the regulations.
9.4 Swiss law shall apply exclusively to these GTC and to any disputes arising from the contract between the buyer and the seller.
9.5 The exclusive place of jurisdiction for any dispute between Raiko Lashes & Beauty / Reine Raiko beauté and any buyer is at the registered office of the seller.
